Acton-Boxborough Regional School District<\/i><\/a>, a case in which an anonymous atheist couple is <a href=\"http:\/\/ncronline.org\/news\/faith-parish\/mass-supreme-court-hear-challenge-pledge-allegiance\">challenging the use<\/a> of the phrase \u201cunder God\u201d in recitations of the Pledge of Allegiance in public schools. The plaintiffs, represented by the American Humanist Association, are appealing a lower court ruling that went in favor of the school district. <!--more--><\/p>\n\n<p class=\"wp-block-paragraph\">With the school year getting underway around the country, here are five facts about the Pledge of Allegiance and its legal history:<\/p>\n\n<figure><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-247307\" alt=\"Facts_1\" src=\"https:\/\/assets.pewresearch.org\/wp-content\/uploads\/sites\/12\/2013\/05\/Facts_1.png\" width=\"32\" height=\"33\"><\/figure>\n\n<p class=\"wp-block-paragraph\">The original version of the Pledge of Allegiance did not include the words \u201cunder God.\u201d The patriotic oath \u2013 attributed to a <a href=\"http:\/\/www.smithsonianmag.com\/history-archaeology\/The_Pledges_Creator.html\">Baptist minister named Francis Bellamy<\/a> and published in a children\u2019s magazine in September 1892 to commemorate the 400th anniversary of Christopher Columbus\u2019 voyage to America \u2013 \u00a0read: \u201cI pledge allegiance to my flag and to the Republic for which it stands, one nation, indivisible, with liberty and justice for all.\u201d<\/p>\n\n<figure><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-247308\" alt=\"Facts_2\" src=\"https:\/\/assets.pewresearch.org\/wp-content\/uploads\/sites\/12\/2013\/05\/Facts_2.png\" width=\"32\" height=\"33\"><\/figure>\n\n<p class=\"wp-block-paragraph\">Congress added \u201cUnder God\u201d to the Pledge in 1954 \u2013 during the Cold War. Many members of Congress reportedly wanted to <a href=\"http:\/\/www.ushistory.org\/documents\/pledge.htm\">emphasize the distinctions<\/a> between the United States and the officially atheistic Soviet Union.<\/p>\n\n<figure><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-247309\" alt=\"Facts_3\" src=\"https:\/\/assets.pewresearch.org\/wp-content\/uploads\/sites\/12\/2013\/05\/Facts_3.png\" width=\"32\" height=\"33\"><\/figure>\n\n<p class=\"wp-block-paragraph\">The children of the plaintiffs in the Massachusetts case \u2013 like all Americans \u2013 cannot be required to recite the Pledge or any specific part of it. That was made clear in a 1943 U.S. Supreme Court decision, <a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/historics\/USSC_CR_0319_0624_ZO.html\"><i>West Virginia v. Barnette<\/i><\/a>, in which Justice Robert Jackson wrote: \u201cIf there is any fixed star in our constitutional constellation, it is that no official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion or force citizens to confess by word or act their faith therein. If there are any circumstances which permit an exception, they do not now occur to us.\u201d<\/p>\n\n<figure><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-247310\" alt=\"Facts_4\" src=\"https:\/\/assets.pewresearch.org\/wp-content\/uploads\/sites\/12\/2013\/05\/Facts_4.png\" width=\"32\" height=\"33\"><\/figure>\n\n<p class=\"wp-block-paragraph\">In 2004, the U.S. Supreme Court accepted a case (<a href=\"http:\/\/www.law.cornell.edu\/supct\/html\/02-1624.ZS.html\"><i>Elk Grove Unified School District v. Newdow<\/i><\/a>) that challenged the use of \u201cunder God\u201d in the Pledge, but the high court did not rule on the question of whether the Pledge is constitutional under the First Amendment. Instead, a <a href=\"http:\/\/www.nytimes.com\/2004\/06\/15\/politics\/15pledge.html\">five-justice majority said<\/a> that <a href=\"http:\/\/secular.org\/bios\/Michael_Newdow.html\">atheist Michael Newdow<\/a> did not have legal standing to bring the case on behalf of his daughter because he did not have legal custody of her. Standing is a legal concept that only those with a legitimate stake in a case\u2019s outcome can be a party to a lawsuit.<\/p>\n\n<figure><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-full wp-image-247311\" alt=\"Facts_5\" src=\"https:\/\/assets.pewresearch.org\/wp-content\/uploads\/sites\/12\/2013\/05\/Facts_5.png\" width=\"32\" height=\"33\"><\/figure>\n\n<p class=\"wp-block-paragraph\">The current Massachusetts case challenges the Pledge from a different perspective than did Michael Newdow, who argued that \u201cunder God\u201d in the Pledge violates the prohibition on the establishment of religion in the First Amendment of the U.S. Constitution. <a href=\"http:\/\/www.religionnews.com\/2013\/08\/30\/mass-supreme-court-to-hear-challenge-to-pledge-of-allegiance\/\">According to the Religion News Service<\/a>, the plaintiffs in this new case are arguing that the recitation of the pledge discriminates against non-believing students and thus violates the guarantee of equal rights contained in the Massachusetts Constitution.<\/p>","protected":false},"excerpt":{"rendered":"<p>Massachusetts\u2019 Supreme Judicial Court \u2013 the state\u2019s highest court \u2013 will hear arguments today in Doe v.
